Assumption of Risk and Waiver of Liability: By participating in the Annual Norm Tanner Memorial Regatta or any sailing, swimming or recreation activity at Bow Mar Lake, BMOI property or member property, I understand that I voluntarily assume and acknowledge the risks of these activities. I understand that the Bow Mar Yacht Club, Bow Mar Owners Inc (BMOI), members, employees, or individuals appointed or volunteering for this event (collectively, the “Releasees”) provide no guidance to or guarantee of safety. I understand that sailing, swimming, and other recreational activities associated with this event can be dangerous and I take full responsibility for assessing conditions of the lake, environment and equipment and will participate only after making a personal assessment of safe conditions. I understand that the activities that I will participate in are inherently dangerous and may cause harm or grievous injuries, including bodily injury, damage to personal property and/or death. I will not participate if I feel the conditions or equipment are unsafe. I will supervise any family members or guests accompanying me and make them aware of sailing, swimming and associated recreational risks. By participating in this event, I agree on behalf of myself or my heirs, assigns and next of kin, to waive all claims for damages, injuries or death sustained by me or expense that I may suffer or that my next of kin may suffer as a result of my participation that I may have against the Releasees WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law and to hold harmless and indemnify the Releasees from any and all liability for any property damage or personal injury to any third party resulting from my participation in the event. If the law in any controlling jurisdiction renders any part of this agreement unenforceable, the remainder of this agreement shall nevertheless remain enforceable to the full extent, if any, allowed by controlling law. I agree to sign additional liability waivers required before being allowed to participate in this event.
